She could have granted him custody at his house. The issue is coming up in the Supreme Court today. The SLP is being filed before the CJI in Delhi on the order of the High Court.

The remand for Babu has been extended till October 5. Babu told the lady judge he was punished for no reason and is being kept under remand.
The judge told him that he was not in jail and was under judicial custody. Legal luminaries are of the opinion that if this goes on Babu could be in jail for another month and that is the minimum period.
