The High court has supported the verdict and has supported the order given by the single bench in the MLAs poaching case. The division bench said that the CBI will make further investigations into the case.
The court has struck down the petition filed by the state Government in this case. This goes against the interest of the state Government.
The Telangana government earlier moved a division bench of the state high court, challenging the judgment of a single-judge bench transferring the case of an alleged attempt to poach four Bharat Rashtra Samithi MLAs into the Bharatiya Janata Party to the Central Bureau of Investigation, people familiar with the matter said.
Apart from the state government, the state director general of police, the Special Investigation Team headed by Hyderabad police commissioner C V Anand and Cyberabad police filed separate petitions before the division bench headed by chief justice Ujjal Bhuyan.
In its petition, the state government challenged the decision of the single-judge bench dissolving the SIT constituted to probe the alleged attempt to poach the MLAs.
It contended that transferring the case to the CBI, which is a central government agency, was tantamount to diluting the entire case.But the HC supported the verdict of the single Bench and the case will be investigated by the CBI.
